Hov Pod Affiliate Scheme - Terms and Conditions

The complete terms and conditions that apply to an individual's or entity's participation in the Hov Pod Affiliate Scheme (the "scheme"). As used in this Agreement, "we" (and "us" and "our") means www.hovpod.com and "you" (and "your") means the applicant. "Site" means a World Wide Web site and, depending on the context, refers either to our site at www.hovpod.com or to your site.

Enrolment in the Affiliate Scheme

To begin the enrolment process, you need to submit a completed affiliate scheme application via the sign-up application form on our site. We will evaluate your application in good faith and will notify you of your acceptance or rejection. We may reject your application if we determine (at our sole discretion) that your site is unsuitable for the scheme. Should your application be rejected, you may reapply at any time.

Links and Form Posts from Your Web Site

This agreement allows you a revocable, non-exclusive, licence for the term of the Agreement, for purpose of referrals from your site to the Hov Pod Web site, to use images for the purpose of referrals to the Hov Pod web site. You are not allowed to alter the images in any way. Any text links may be altered so long as the text is in no way detrimental to the reputation of Hov Pod. You may also alter the linking format in order to link to different pages within the Hov Pod Web site (this is done at your own risk). To allow us to accurately report the referral information to you and to accrue the fees, you must use the HTML form supplied by Hov Pod. We will not be liable for any fees on sales made, which are not correctly tracked because the posts from the form on your web site are not in the proper format.

Processing our orders from your referrals

It is our responsibility to take and process order from customers who follow referrals from your site to ours. We have the right to reject orders at our own discretion and subject to our own credit authorisation rules. We are responsible for all aspects of order fulfillment and processing including customer service. Using the form provided to you, and your affiliate code, we will track any orders generated from referrals from your site and provide data on this to you, including referral fees due to you.

Referral Fees

We will pay you referral fees on the completion of sales of Hov Pods. For a sale to generate a referral fee, the customer must have completed the form on your web site and that information must be passed through to the Hov Pod site. The customer must have accepted delivery of the Hov Pod and have made payment in full to Reaction International Ltd or our representative dealer. Fees will be paid after the completion of any sale, and will be paid by cheque or by PayPal.

Customers

Customers who buy products through the Hov Pod affiliate scheme are customers of Reaction International Ltd or one of their representative dealers. This means Reaction International Limited or one of their representative dealers are responsible for all aspects of fulfilment and customer service and that our standard rules, terms and procedures apply to the transaction.

Responsibility for Your Site

You are responsible for your Web Site and for all content on your site which includes:

• Display of Hov Pod Hovercraft images and text and maintenance of the pass through form to the Hov Pod web site in the correct format.
• Non violation of Hov Pod property rights (e.g. copyright, trademark, privacy, libel)
• Maintaining the legality of your own site
• Maintenance of accuracy of all content and information about the Hov Pod.

Term of the Agreement

This Agreement starts with our acceptance of your application to become an affiliate. Either party may terminate at any time. You will then be eligible for any fees accrued during the term of the agreement.

Changes to this Agreement

We may change any of the terms of this Agreement by posting a new Agreement on our Web Site at http://www.hovpod.com. If you find a change is unacceptable, then you are free to terminate this agreement

Limitation of Liability

Neither we nor you will be liable for any amount in excess of the total referral fees paid to you or payable to you. Neither you nor we will be liable for any consequential losses, punitive damages or additional expenses

Disclaimers

Neither we nor you nor any of our representative dealers make any representations or warranties about the accuracy, suitability or completeness of:

• The information continued in the documents and graphics published on this site: or
• Any of the products of whatever nature which appear on this site, and which may appear on your site under the terms of the Hov Pod Affiliate Scheme.

Jurisdiction

Contracts formed between Reaction International Limited and users as a result of using this site shall be governed in all respects by English law and all such users hereby submit to the non-exclusive jurisdiction of the English courts. Further this Agreement shall be governed by English Law and both parties agree to the jurisdiction of the English Courts.
